1. Acceptance of Terms
By accessing and using the Privemen Health Pvt Ltd website and telehealth services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
Privemen provides telehealth consultation services for men's health conditions, including hair loss, erectile dysfunction, and other sexual health concerns. Services include:
- Online medical questionnaires and assessments
- Video/audio consultations with licensed Indian doctors
- Digital prescriptions for FDA-approved medications
- Medication delivery directly to your address
- Subscription-based recurring delivery plans
3. Eligibility
You must meet the following eligibility criteria to use our services:
- Be at least 18 years of age
- Be a resident of India
- Be a male patient seeking treatment for men's health conditions
- Have a valid email address and phone number
- Provide accurate and truthful medical information
Privemen reserves the right to verify your eligibility and deny service to users who do not meet these criteria.
4. User Responsibilities
You agree to:
- Provide accurate, complete, and truthful medical information
- Disclose all relevant medical history, allergies, and current medications
- Inform doctors of any changes in your health status
- Follow medical advice and treatment guidelines provided by doctors
- Use prescribed medications strictly as per dosage instructions
- Keep your account credentials confidential
- Report any technical issues or unauthorized account access immediately
5. Consultation Terms
Doctor-Patient Relationship
A valid doctor-patient relationship is established upon successful completion of your first consultation. Doctors are licensed medical professionals registered with the Medical Council of India.
Medical Assessment
Doctors will assess your eligibility for treatment based on the information provided. Treatment may be deferred, modified, or declined if the doctor determines it is medically inappropriate or unsafe.
Not Emergency Service
Privemen is not an emergency medical service. If you experience a medical emergency, please contact local emergency services (dial 100 or 911) or visit the nearest hospital immediately.
6. Prescriptions and Medications
Digital Prescriptions: Prescriptions issued by our doctors are valid digital prescriptions under Indian law and accepted by all registered pharmacies. Prescriptions are issued in your name only and are non-transferable.
Medication Safety: You acknowledge that medications carry potential side effects and risks. You assume full responsibility for any adverse reactions. Always inform your doctor of any existing health conditions or medications.
Contraindications: We reserve the right to refuse medication if the doctor determines it poses health risks or contradicts your medical history.
Shelf Life: Medications are shipped with appropriate shelf life. Once received, store as per packaging instructions. Do not use expired medications.
Follow-up Consultations: Follow-up consultations may be required to assess treatment efficacy and safety. Continued treatment may be conditional on regular consultations.
7. Subscription and Billing
Billing Plans: We offer monthly, quarterly, and semi-annual subscription plans. Billing occurs on your chosen schedule automatically through Razorpay.
Payment Method: Payment is accepted via credit card, debit card, and digital wallets. All payments are processed securely by Razorpay. We do not store your payment card details.
Billing Address: A valid billing address in India is required. Charges will be made to the payment method you provide.
Failed Payments: If a payment fails, we will attempt to process it again. Repeated failed payments may result in suspension of your subscription and service.
8. Cancellation and Refund Policy
Subscription Cancellation: You can cancel your subscription at any time from your account dashboard. Cancellation takes effect immediately, and no further charges will be made.
Refund Eligibility: Refunds for charges already processed are issued within 7-10 business days following applicable refund policy. Prescription medications are non-returnable once dispatched.
Medical Grounds: If a doctor deems treatment unsuitable, charges for that consultation may be refunded at our discretion.
Pause Option: Instead of canceling, you can pause your subscription for up to 90 days without incurring charges.
9. Telemedicine Consent
You acknowledge and consent to telemedicine consultation as permitted under the Telemedicine Practice Guidelines, 2020. You understand that:
- Telemedicine consultation may not be appropriate for all medical conditions
- In-person consultation may be required for certain diagnoses or treatments
- The doctor may refer you to an in-person consultation if medically necessary
- Technical failures or connectivity issues may interrupt consultations
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIVEMEN SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunity
- Medical outcomes or treatment results (subject to medical malpractice provisions)
- Service interruptions due to technical issues or force majeure
- Third-party actions or unauthorized access despite our security measures
Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
11. Medical Disclaimers
Not a Substitute for In-Person Care: Our services are not a substitute for in-person medical consultation. Complex cases may require physical examination and tests not possible via telemedicine.
Professional Judgment: All treatment decisions are based on the doctor's professional judgment. Treatment may be declined, modified, or deferred at the doctor's discretion.
No Guarantee of Cure: We do not guarantee cure or specific treatment outcomes. Individual results vary based on medical history, adherence to treatment, and other factors.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of India, specifically:
- Information Technology Act, 2000
- Consumer Protection Act, 2019
- Telemedicine Practice Guidelines, 2020
- Medical Council of India Regulations
13. Dispute Resolution
Grievance Redressal: Any disputes or complaints should first be reported to our support team at support@privemen.com. We will attempt to resolve disputes amicably within 30 days.
Arbitration: If the dispute cannot be resolved amicably, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with a single arbitrator in Delhi.
Consumer Forum: As per the Consumer Protection Act 2019, you have the right to approach the Consumer Disputes Redressal Commission if dissatisfied with our service resolution.
14. Intellectual Property
All content on the Privemen website, including text, graphics, logos, and software, is the property of Privemen or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or transmit any content without our prior written permission.
15. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes become effective upon posting to the website. Continued use of the Service after changes implies your acceptance of the modified terms. We will notify you of material changes via email or prominent website notice.
